WAIVER

Customer Waiver and Release of Liability

In consideration of purchasing and consuming hot food challenge snacks made with Carolina Reaper chili from BADASS CHALLENGES, hereinafter referred to as "the Company," I, the undersigned customer, hereby acknowledge and agree to the following terms and conditions:

1. Assumption of Risk: I am fully aware that the Product contains Carolina Reaper chili, which is considered one of the hottest peppers in the world. I understand that consuming extremely spicy foods, including the Product, may cause discomfort, physical reactions, and potential health risks, including but not limited to digestive distress, sweating, burning sensations, and potential exacerbation of existing medical conditions.
2. Health Considerations: I affirm that I am in good health and have no known allergies or sensitivities to spicy foods. I acknowledge that I have consulted with a medical professional if I have any pre-existing medical conditions, allergies, sensitivities, or concerns regarding my ability to consume the Product.
3. Voluntary Participation: I willingly choose to participate in consuming the Product and fully understand the potential risks involved. I acknowledge that my participation is voluntary and solely at my own discretion.
4. Release and Waiver: I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, discharge, indemnify, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from any and all claims, demands, actions, liabilities, losses, damages, costs, or expenses, whether foreseen or unforeseen, arising out of or related to the consumption of the Product.
5. Acknowledgment of Responsibility: I acknowledge that I am solely responsible for my decision to consume the Product. I assume all risks associated with the consumption of the Product and hereby waive any claims I may have against the Company arising from such consumption.
6. Capacity to Understand: I affirm that I am of legal age and possess the mental capacity necessary to understand the terms of this waiver and release.
7. No Guarantees or Warranties: I acknowledge that the Company does not make any guarantees or warranties, either express or implied, regarding the effects, taste, or reactions resulting from the consumption of the Product.
8. Governing Law: This waiver and release shall be governed by and construed in accordance with the laws, without regard to its conflict of law principles.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY CAREFULLY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY, AND I SIGN IT VOLUNTARILY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE.
